Because our employer did not conclude my and my wife's new contracts as promised over the weekend 4th to 6th November we chose to resign and did so verbally and in person. The employer would not accept our decision and pursued us for almost 2 weeks. Over the phone we finally reached an agreement after reviewing new contracts put forward over a number of days around 15th 16th November (I have emails to prove this) and both duly signed and witnessed and sent both to the employer immediately who promised to sign and return immediately. They did not keep this promise but after an email from myself I received an email 28th November 2011 that stated "employment contracts are in the mail". Another lie!
We have never received them. On 3rd December I received a phone call and asked for the contents to be placed in writing after listening for less than 30 seconds of this conversation. I received an email stating that the employer had now decided to accept our original resignations and made an offer that we considered completely inadequate.
After being worn down with no sensible response I took the plane ticket offered to return home 5th November and mentioned I would need adequate baggage allowance to which I was told the next morning of the flight that there were no seats that day. I went to the Darwin airport at the departure time 12.45pm Qantas Monday 5 December 11 and spoke with 2 Qantas counter staff - one on the baggage book in counter for the flight and the other the actual baggage handler who happened to be at the counter also. I was informed that there were “more than plenty of available seats no matter what type of ticket I had”.
When I learned that the new booking had a baggage allowance of only 15kg on opening the eticket which I had received the next morning - I had been working in Darwin since September and this was highly insufficient. I needed the 23kg at least – I decided to purchase my own ticket to Brisbane from Darwin so I could return home to Brisbane, which I did.
We have now received an email as I came in the door stating “Hi Wayne,
I have placed last night an amount of $2201.58 into your account. Holiday pay will go into the account next week.

I had not accepted this arrangement and again state I certainly never agreed to any offer from them except air-line ticket which I did not use for the reasons given above. Apart from “holiday pay” mentioned in this email which I was told would be 2 weeks, there is the promised additional and agreed 2 weeks “in lieu of excessive hours" (my working no fewer that 90 hours per week for the first 4 weeks and the company promising to pay 2 weeks for these 4 weeks.
Strangely enough even though we have never received the promised contracts, all pay rate offers have been offering the pay rate of the newly agreed contracts which the company promised us but which never arrived. I have worked in excess of 70 hours since the first 4 weeks and have documented daily work hours from my first day on the job.
We feel we have been lied to and strung along throughout this whole ordeal.
