Hello

I'm writing this on behalf of my mother as she is not on enail.

She has property in Australia (joint owned between my father) which she had to leave due to difficuilt circumstances when they divorced several years ago. My father has recently passed away, with him leaving his new wife the property.

My Mother believes her name is XXXXX XXXXX Deads, is there anyway she can contess the Will my Father has left and claim back her half of the property?

Do either your father or mother live in Australia, in your fathers case before he passed away please?

My mother was forced to relocate back to the UK (her place of birth) when they divorced several years ago.

My father remained in Australa until his death earlier this month.

Was your fathers will made in Australia?
Did they divorce in Australia or the UK?
If in the UK did they get a consent order and if so what did is say about the property?

Hi

His will was made in Australia.

My Mother had to return to the UK when they first separated and divorce papers were later served to her whilst she was here.

Thanks. I don't think I can help you much on this in that case. This is jurisdictionally going to be very much Australia and I think you need the input of an Australian lawyer rather than an English one. I have a feeling this site has an Australian law section. I will check now and if so transfer the question to that section.
