Hi,My name isXXXXX have a 7 year old daughter who I have a 50% custody court order agreement with. Over the last couple of weeks I have been receiving a ridiculous amount of phone calls and text messages from the other party,for example she has been saying that I am not going to see my girl when it is my turn,and she has been saying that I'm turning our daughter against her,which is not true. Anyway some of the things that have been going on at her address recently have my daughter and I worried. About 6 weeks ago her Mother had a small party a fight broke out that night between her mother and boyfriend and my daughter seen everything,which really shook my daughter up,2 days later when my daughter came into my care she told me what had happened and she also said that she had been hit in the face as well,so obviously I went straight to the Police and reported it,the Police told me they were called to her address that night for a noise complaint. The mother had kicked him out of the house,but they got back together a few days later and my daughter also told me about 2 days later that she had not been hit,she said she just wanted him to get in trouble for the the things the boyfriend had done to the Mother that night. Moving on to the next part of the story, last Saturday night around 8pm I starting to receive continuous text messages and phone calls about the things I had mentioned earlier, when I say continuous I mean the calls were almost non stop until about 10pm,I did answer some of the calls and text messages,but not many and it was the same old crap just yelling at each other. I had a fair few drinks that afternoon watching the A.F.L grand final so the calls and messages really stirred me up. About 10:30pm that night a friend asked me if I wanted to go to the pub for a couple of beers,"I said o.k but on the way I'm going to stop in at her house and sort this crap out". I know it was a bad idea but I went there anyway. When I arrived she was down stairs playing pool and she seen me coming up the driveway, she came out to me,an argument broke out,she slapped me across the face twice very hard,then not long after the boyfriend came out and hit me with his fist and also a pool cue,which was broken on me.I did not throw 1 punch the whole time. I walked away,called the Police and they also sent an Ambulance. On Monday morning my daughters Mother called me and left a message on my phone saying that I was not going to see my daughter that afternoon after the weekends events,I called her back and said you try and stop me I think you have caused enough trouble already,she also left my daughter in her boyfriends care that morning and he started harassing me with threatening phone calls and messages. That afternoon when I picked my daughter up from school, she seen my face and started to cry,she told me some of the things that he had said in front of her that morning,like he was going to get 50 friends and come and kill me. Anyway everything that he said has been reported to the Police. I'm sorry about the long story,I'm just confused with witch direction I should go now legally,should I go for full custody or should I change the court order where my daughter is not to be left alone in his care. My daughter is a bit afraid of him and she doesn't like him. Thanks
