I think there is a good chance that if you hire a criminal lawyer to fight this charge, that you would succeed. However, your chances would have been even better if you had gone inside and the police then knocked on your door and breathalised you.
The problem for the police is that they cannot prove you were driving the vehicle whilst intoxicated, only that you were in the passenger seat whilst intoxicated. I would place your chances of beating this charge at about 66% with the help of a criminal lawyer.
