My part-time university-student (part-time work) son was involved in car accident on Broadway, Sydney on the weekend. He and a motorcyclist were struck by a rental car carrying three tourists, which was driving across their oncoming traffic lanes, making a turn. Both sides contend that their lights were green - my son and the motorcyclist insist that the light facing them was green, the tourists are just as adamant that they had a green arrow. Police attended the accident. Verbal advice, on the scene, was that circumstances favoured my son and the motorcyclist. My uninsured son had his `totalled' car towed to the tow-truck drivers work site - after the three days storage attracting a per-day charge. It is undriveable. The car was purchased for $2000 and is uninsured as he is only 22. On the fourth day of storage - the start of the per-day storage fee - the attending police officer, who had stated he was to check if the traffic lights were faulty, advised my son that `no fault' would be assigned. The two separate drivers against the three contentions in the one car. The car was left in storage to make it accessible to any rental car assessors. We live in Inner West Sydney and have no off-road parking for a wrecked car. We are unsure as to how to proceed. No fault would seem to limit legal claim - particularly as my son is uninsured. He is taking legal advice from friends and tow-truck drivers who suggest making a claim and believing the rental car agency will pay rather than incur legal costs. By the same token, the car is worth $2000 and that would seem the highest he can claim. It would seem that legal costs, for him, will not take long to pass that mark. And there is the matter of car storage and where to pay the exorbitant towing fee - an amount of approaching $400 for a fairly local trip - if it cannot be stored at home. Is there a need, for legal requirements, to have it documented as `written off'? Will photos be acceptable in accessing that statement? Can the car be taken to a wrecker or equivalent? What is the best course of action? Is it worth pursuing in light of the police finding?
