How can a council be prevented from destroying a building (former kindergarten) that was built and paid for by the community (then entrusted to the council to look after) until proper consultation, explanation and agreement be sorted out (with said community)? What sort of costs for an injunction would this likely involve?
The community Township Committee asked council to refrain from demolition and hold discussions with the community. Council are pushing forward to quickly destroy the building and are unwilling to have community consultation until after the building is destroyed. The council has refused acess to site for the community to have professional independent inspection. Community has not been part of the decision making process and have not been given any minets or opertunity to contribute to the decision that the council has made to demolish the building. Community has been trying to have this building restored and returned back to use in the community for 5 years. This has included proposals for a community center that would strengthen and support the whole region. Council has made decision "in camera" at a briefing meeting without consultation of the community to buy another property that is much less suitable (parking, access and safety issues along with less suitable location further away from towns center). The purchase of this building was completed without consultation of the community. The costs the council has given for the purchase and "fit out" the new building plus their costs to demolish the original building exceed the councils own quotes to repair the building they want to destroy.
