I have a complex family-law question. My husband (austrlian) and i (german) met in germany in 2000. We wanted to live in germany however his visa application got rejected. We decided that it would be easier that we would get married in Australia than in germany. At the same time my husband propsed that we would also live in Australia for a while so that he could finish univerity, and would then move to germany. I agreed to that. He finished Uni and said "lets save some money before we go so we have a good start in germany". I agreed again and also got pregnant. My husband went to germany in the meantime to look for a job. i got pregnant again. because my husband had been working 6-7 per week we had no relationship with each other i felt extremely lonely for the years that i have been in austrlia. the kids hardly knew their dad. Sick of his empty promises to move back to germany and not following through on it I had threatend to leave him -unaware of the custody-issue ahead. He then agreed to move but we couldn't agree when: He said march 2011, i said september 2010.We had already packed our household and shipped it off to my parents house in germany. The goods arrived there in sepember 2010 and my husbands visa was also due to be issued in september 2010. My husband and i and the kids went to germany in sept.2010 to take care off formalities. My husband booked return flights, although i didn't want to come back to australia. I left the decision open whether i would return to sydney and wait with the move till march 2011 because now that my husband had finally agreed to move i wanted to give the marriage a go. At the sam time I didn't see any legal obligation in having to fly back just because we bought return tickets.
We arrived in germany and registered the kids (who have australian and german citizenship) with primary residence in germany. A day later i found out that my husband had molested his younger cousin (she was 4 back then, he was 15) and that he used to deal drug and steal cars etc. I had no idea about his past despite always having asked if there is anything i should know. I didn't talk to him about this because i was devestated and shocked and needed time to get my head around this. I was also worried for my girls.
2 days later my husband - i still hadn't spoken to him about what i found out- he told me "send back our stuff, but it doesn't mean that we won't move in march!". I told him that i can't trust that he will still be moving to germany and stayed with the kids at my parents house.
He went back to australia and got a Court order under the Hague convention to return me and the kids.
Now i'm back in sydney with the kids and we want to go back home to germany where i have a job waiting for me. My girs (3+5) have very little emotional bond with their father because he always worked and was never home. My girls are also very much emotionally attached to their german grandparent.
My husband now wants shared custody in australia.
I'm desperate to go home because i have no support network here. I rely on a german friend here but she is all i have and i can't continue to burden her.
Lawyers have told me that i have close to no chance that i can go back.
I believe that my husband kept me in australia under false pretences for all the. I would have never married him if he wouldn'y have promised that we would live in germany and if i would have known about his horrible past.
Is there any way out of this for me and the kids???
