VerifiedIf it is a first offence, often a fine is payable and the Magistrates records a conviction against you. It is very rare for a first offence that the Magistrate would sentence you to jail.

The Magistrate will decide what your punishment would be, and he can sentence you to jail. But as I mentioned before, on a first time stealing offence of an amount under $300, it would be very rare for him to do that.
Instead he will probably sentence you to pay a fine as well as record a conviction against you, so you will end up with a criminal record.
