Dear Sir, my daughter is being made redundant. She was given a signed letter dated 17 March 2020 by the principal of the company stating she would receive 4 weeks redundancy pay and accumulated statutory and contractual entitlements up to and including termination. On 24 March 2020 she was given another letter retracting the 4 weeks redundancy pay. Stating that due to the size of the company there would be no entitlement for her as a redundant employee to receive redundancy pay. My question is: as she has a signed letter stating that she will be paid redundancy has the company, regardless of size, a legal and moral obligation to honour the initial letter. The employer terminated my husband's fulltime permanent employment on the basis that there isn't enough work for him, and with a vague offer of possible casual work (unspecified) as a way of 'keeping him with the company'. We consulted Fair Work (website, phone call, calculator online) and Legal Aid on phone and our accountant – the conclusion was 6 weeks' redundancy pay is due. The job finishes tomorrow. The employer claims no redundancy pay is due as they have checked with Fair Work. But they keep saying there just isn't enough work to keep my husband on fulltime. And he hasn't offered an acceptable alternative, so my husband is looking for fulltime work somewhere else. We have no financial alternative but to do this as he is the main earner for our family. … read more
