What about the fact that I am under going a Debt Agreement, which would obviously indicate that I am not able to afford to pay off her debts? And how would going bankrupt completely affect that?

That is at a last resort, but aren't I considered bankrupt under the Bankruptcy Act Part IX? I would rather explore other avenues first and am trying to find out what other avenues I have available to me? I am sure that I am not the only person to be put in this situation. I thought that once I had signed the forms to have these accounts signed over to her and the car (including registration) that all of this would have been taken care of. I have only found out recently that they haven't. Surely there is something that I can do?

The point is that I do not want my name attached to any of her accounts. How can I get my name off her accounts?

All I can find in my paper work is a draft copy from the mediation body Relationships Australia. I have called them for a copy of what I might have signed but they only have the draft copy also. To be honest, Im not really sure if I signed anything. Is that possible? Who would the property settlement have been lodged with? We didnt go to court and I didnt have a lawyer. Its all very hazy due to the stress of the time. We agreed that she would take the car, which I signed into her name - she has been paying that ever since - but she has not changed the loan, which makes me liable for about a $20,000 loan if she gets into trouble. We also agreed that I would take the $9,000 credit card in my name and she would take the other $9,000 credit card which was in joint names. I assumed that she would have put that in her name and to my knowledge signed that over to her with the rest of her accounts which she has not changed. I hope this helps.

As far as I can remember there was the agreement with relationships australia. If there was forms lodged with the court, who do I call to find out - although I think this is unlikely.

OK Thanks for the information. I called the National Enquiry Centre today and all they have listed is the actual Divorce. What should my next step be??

No - I do not have a good relationship with my ex wife. I have asked her to to sort out these accounts but she is being extremely difficult and I have no other option but to cut contact with her and sort it out myself. She is a very controlling person, and I just want this to be over, and I will do almost anything to make that happen.

Are you saying that there is nothing I can do? Even though I am essentially bamkrupt now? That she can have me on her accounts after we're diviorced?
