Good Morning,
You have 12 months from the date probate was granted to contest the will.
If you believe that appropriate provision has not been made you can contest it.
It is hard for me to say if you will be successful in order to know your chances of success you should take a copy of the will to a Solicitor and get more detailed advise.
The law looks at your dependency on the deceased and also your financial position compared to the other beneficiaries.
It takes into account all of this and determines whether the testator should have made better provision for you.

I cannot say if you will get 50/50 but if you were dependent on your mother then the court may change her will and give you a share of the house.

My mother passed away 3 weeks ago. In the years just before that, she was in government housing (in Perth, W.A.), with my brothers and sisters looking in on her. As she progressively changed from being quite independent to suffering dementia, my brothers and sisters shared the task of calling in on her and doing some general cleaning, preparing meals, and looking after her banking. I never thought to be kept informed of her financial affairs because my two sisters just took control of that. I now have reason to be suspicious that my mother's financial affairs might have been manipulated to favour at least one or both of those sisters. Also there were cleanliness issues in the unit where my mother lived, just before she was put into a nursing home, about 18 months ago. I am also concerned about my mother's will, not so much what I might be left with, but whether it was legally prepared before my mother's dementia was realised.
