Hi, My partner is about...

Hi, My partner is about about to appear in court for knowingly obtaining payment of social security payment 46 counts in Tasmania and is pleading guilty the letters from centrelink state the over payment amount is $10,000. It was over roughly a two year period while on carer payment ( for myself due to post natal depression) he was casualy working and not declaring earnings. At the time we were in severe finacial hard ship and can proove that and was sort of a need not greed situation. wHAT ARE THE USUAL PENTALTIES for this amount ? please help Im so scared as we have two small dependents.

Good Morning,

The can sentence him to Gaol as the worst case scenario.

If he is responsible to provide for the children the court can take a more lenient approach and simply issue a fine and put him on a good behaviour bond.

He will need to repay the money he has received due to the fraud and if he has already started this will be looked at favourably by the court.

If this is a first offence the court will take that into account. It also looks at the time period that it was done over.

If this is a fist appearance he should enter the plea of guilty and seek an adjournment to seek proper legal advise so that on the next occasion he can have the necessary documentation and references to assist in getting a better sentence.
