My father bought house in 1979 and in the early 80' changed
my father bought house in 1979 and in the early 80' changed fence with neighbour. fence was put back in the same spot.new owners due to sale of deceased estate. bought house in 2013. the fence has been in the same position for over 40 years. in 2018 he asked for permission to remove fence for a development on the boundary line. my father gave permission without seeing details. he's 83 with poor english. i received phonemail when the they were going to start building to tell me that the title was out and he wanted to reclaim his land. we were not aware of any disrepencies and there was a brick pillar in the front fence from 1954 when the house was built... there was also as attached wall up to the fence. this wall is connected to the house as it it was built at the same time. we said no as the fence has been there for over 40 years. he built his garage/development behind the side wall. that was he agreed to. he tried to bride my father by saying that he build the fence for free and redo all his concrete. al my father had to do was give him back his boundary. we had not seen any titles etc. we have done a land survey and yes there is boundary issues but the whole i out by the same amount. just to note that this owner built a new fence on the other side of his property which was all encroached … read more
