I bought a block of...

I bought a block of land three years ago. The real estate agent told me sewerage is available. On the section 32 it states sewerage is available. I specifically asked my solicitor to check this before I made an offer as I was looking for a no problem block of land. I have decided to sell used the same solicitor for the new section 32 and now my realestate agent tells me there is no sewerage is available so the block needs a septic tank!! both the section 32 I bought the property on was deceptive and the one I have just had made up has to be changed. Firstly I could have negotiated a better price when I purchased the block had I known there was no sewerage and secondly I am now looking at loosing some money due to a lower profit on my sale and a longer sales process as less people are interested in a block with no sewerage. I would not have bought this block if I had known this before, I paid my solicitor to go over the section 32 prior to purchase. thanks rachel feldt

Hello Rachel. You may well have a claim here, either against your vendor or your own solicitor. This should have been properly notified in the s32. You will only get proper advice by seeing a new solicitor - your current solicitor is conflicted. One thing you will have to keep in mind is whether you can prove your damages - amongst other things you will need some expert valuation opinion. I think you should see a new solicitor asap. I would recommend Russell Cocks of Boyle & Associates in Williamstown; he is Victoria's premier property lawyer. Come back if you have any further query.
