Went to a mechanic last...

Went to a mechanic last October for a quote to fix the my work Ute, he said he was unable to quote on it. He fixed it, the head needed to be reconditioned. Cost 4500. a month later, more work needed to be done at 2000. Total cost 6500. 8 mths later, motor blew up. I took to a second mech who said the camshaft was not tightened properly when the first mech done the job. Second mech rang first mech and told him. First mech came and apologized, and is currently fixing the problem. my Ute has been off road for 7 weeks. I have lost allot of work, can I claim that loss. And the other exp?

In that case, you need to commence proceedings against them in the Queensland Civil and Administrative Tribunal (QCAT).

To do so simply call 1300 753 228 and ask them to post out to you a Form 3 - Application for Minor Debt. Fill it in (it is relatively self explanatory), and then post it back to the QCAT (details of the location will be on the form) with the filing fee.

The QCAT will give you two (2) copies of the stamped claim form. You need to arrange to have one of the stamped copies of the claim forms delivered to themechanic you are claiming against as soon as possible once you receive them.

Once they file a Defence to your Application, the matter will be set down before a judge who will hear both sides at a hearing before ruling on the matter.
