No, the police report would not be a pre-requisite to bringing a small claim against this driver - although, of course, it would have been helpful as evidence.

My car was driven by my son Sulaiman Shamil licence no###-##-#### My car stopped behind Daniella's car, and we were both at a complete stop. Then my car was rear ended by Asmelash T Mekonen. My car as it got hit moved forward and hit Danielle's car. We pulled over to the side of Witton Street. Asmelash T Mekonen admitted fault and informed us that he was not insured. We exchanged details, we idealised on calling the cops, but Asmelashadmitted that he was at fault and agreed to repair Danielle's and my vehicle and insisted that we should not call the police as he was driving without P plates being displayed and had no insurance cover for his vehicle.I followed up with Asmelash the very next day with a quotation from a familiar vehicle repair centre, a copy of which I have. Asmelash said that the quotation was too high and requested me to take my vehicle to a panel beater known to him. The address of the panel beater recommended by Asmelash was, Crystal Mechanic,***** Sunshine 3020. I took the car to Crystal Mechanic on his advice on the 15th of January 2022. Steven from Crystal Mechanic informed me that he will give the estimate to Asmelash.On the Monday the 17th of January, I tried contacting Asmelash after the quotation was given to him by Crystal Mechanic, but he failed to respond. Asmelash called back on Tuesday, 18th of January, and said he had a family emergency and requested for two days to sort out his finances to pay for my car repairs.
