Your ex partner cannot commence court proceedings unless you have attempted mediation first and he has obtained a certificate. IF you refused to attend mediation then he would have received a certificate.
I would suggest you try mediation to discuss the matters.
The court would have to make orders that are in the best interests of the child. As a first option they have to consider whether the child spending 50% time with each of you is in the child's best interests. This will depend on the age of the child, how close together you live, your personal circumstances such as availability to care for the child.
