Initially i wish Bruce all the best and i hope that he has exhausted all options to have a Solicitor present. Family law is a specific field and open to many issues and options.
For a property settlement to be dealt with in court there is a need to give full and frank disclosure of the assets. This is inclusive of superannuation amounts especially if there have been a sum of money withdrawn previously.
Bruce needs to make specific reference of the false figures and request full and frank disclosure of the super with both a letter sent to the Solicitor and requesting it in court.
Bruce should also file an Affidavit in court outlining anything that he disagrees with in regards XXXXX XXXXX to clarify.
At the end of the day, a court cannot make a judgment on whats fair and equitable separation of assets without having all the information before them.
I would also advise Bruce to also have a copy of the signed agreement both of them made before a JP showing that there was an agreement made previously and try to rely upon it and enforce it.
In regards XXXXX XXXXX's fees and tax debts, this can also be arranged into the property settlement.

This is a NSW matter. What my issue is that around September last year I started proceedings to get a property settlement and later to get a divorce finalised. My estranged husband has done everything he can to hold everything up and refusing to do anything towards the settlement. He has claimed that he will do everything he can to use all funds that we have in legal fees so that I get nothing. He has locked me out of accounts, disconnected my phone. Dropped me from health funds and so on. He has been an abusive partner over many years and there is a database of problems known to the local police with an E number issued. At first he was going to represent himself and took his time answering requests from my solictor. He then engaged a solicitor and only contacted her andomly. just now he has engaged a solicitor I think on a permanent basis. My solicitor and I lodged financial statements and affidavit with the Federal circuit court and were given a date of the 9 May to appear. My estranged husband did not appear not did his solicitor. My husband has not even done anything about filling his part of what is required. He constantly makes excuses as to why he can't do so. Why is it that he can get away with this? Is there anything that we can do to force his hand? I just want to get things done with and there is no good reason that this can't be done. Have you any suggestions? Regards Helena. … read more
