The officer saying something like "Yeah, you could really take it anyway" does not sound to me like an acknowledgment that they knew you had no intention of stealing the taxi. That's important because if they actually did say something like that, the stealing charge would likely get tossed, and then you'd only have to deal with the drink driving charge.

As it stands, you are being charged with both. In answer to your question, if you have no previous criminal record, and plead guilty to these offence, I would estimate that you will be sentenced to three months imprisonment and a $500 to $1000 fine, with a conviction being recorded against you. Your drivers license would also be likely to be suspended for about 3 months.

At this stage, my recommendation is to see a criminal lawyer who can more closely examine the tape of the interview to see if the policeman's comment can at least get the stealing charge thrown out. Even if the recording doesn't offer any hope there, I think that charge is still vulnerable because the police have to show intent, which can be difficult for them if you were just goofing off.
