These are very complex questions. What you need to do is see a barrister and have the barrister draft a Legal Advice on these question, an Advice which researches the case law (especially similar cases) and which also looks at the legislation.
It may well be that a constitutional challenge is in order, but the only way to know that would be to have the barrister's written Legal Advice drawn up first.
