I was retrenched from my position as HR Manager with a
I was retrenched from my position as HR Manager with a contract mining company in May this year. As part of my salary package my employer fully paid for my leased vehicle. At the time of my retrenchment my vehicle was only into the first year of a four year lease term. Consequently the payout figure on my retrenchment was $60k. I immediately spoke to my employer and he agreed to take over the lease on my behalf. I handed the vehicle back to my employer and he was going to sort the necessary transfer of lease through the lease company. It was then discovered that leaseguard insurance had been taken out on the car, therefore, the insurance company was to pay the lease repayments up to the value of $15k. These payments will cease in November of this year. My question is as this was part of my salary should it be my full responsibility to payout the remaining residue on the car. As I explained previously to my employer I would not have re-entered a new lease had I know I was going to be retrenched. could you please advise. … read more
