Hello Leon, All of my communication has been via email, txt or phone with the builder. I accepted his quote in an email communication - this is what I consider the contract.

The quote says 10% due on commencement, 30% due on delivery of hard goods, 55% due on completion of tiling and other sundry works and variations if applicable and 5% (full balance) due on shower screen installation (final completion). All works are completed strictly on the basis of payment in full on completion, when due.

Payment may be by cash,cheque or direct transfer - personal or electronic. I didn't want to inspect the partially completed job, I wanted to inspect the fully completed job prior to making the final payment. I cannot get to the property until Saturday because of work commitments.

This is what he said in his email:

We will require that final payment is made in full on the day of fitting of the shower screen/mirror- before the fitter leaves the site. If you wish to be there personally then you will need to ensure you are on site before the fitter leaves the site and payment must be made in full before the fitter leaves the site. Be mindful that because of work schedules the fitter can not give an exact time of arrival- normally it is either AM or PM, on the day and is subject to change; due to unforseen aspects of other sites. If for any reason the final payment is not paid in full, then the shower screen and mirror will be removed on the day and will be subject to a $350.00 re-fitting fee.

Do I have any right to say I don't agree?
