VerifiedHi meggy, when a court makes parenting orders, the primary consideration is the welfare of the children, although there is an assumption of equal shared parental responsibility in the making of parenting orders, if you can give evidence to the court that it is not in the best interests of the children to be in the same location as their father then you can overcome this presumption and have the court order that the children should be in a more supportive environment. You could document who is paying for the upkeep of the children and the travelling of the father so far and any evidence of abuse which will help to show that allowing them parenting rights is not in the best interests of the children.
