My husband of 26 years separated last September. I went to a domestic violence refuge before finding a place to start from scratch. He got an AVO on me when I was in fact the victim. I left due to the abuse and when I got home from work he and his girlfriend locked me out. Anyway after a while we came to agreement that he would give me half his share on house sale that he and his 2 siblings also had a share in ( mums home). I lived there and looked after his mum for 9 years before she passes away we lived there for a further 10 years until siblings decided to sell. This process started before separation. The house sold for $800 000. Husband got $200 000 and agreed I would get half. Since settlement he has spent and hidden $150 000 of it and has been doing everything he can to not make it to the bank on time to transfer the funds. 3 weeks later he is spending my share. He also owes me $5000 & when my dad passed away I spent inheritance buying him a bike for $25 000 & he agreed to pay me for half. He has not worked or contributed to household expenses for the past 5 years. What can I do? I trusted that he would do the right thing. my ex-husband is refusing to sign documents to release my share (or his) of proceeds of former matrimonial home; court orders for 50/50 split dated 31 July 2015 : Fedreral Circuit Court Australia/Sydney; property sold and settled on 9 September 2016; orders allow for wife to receive ($34,064.32) "to be deducted from the payment to the husband from the sale proceeds of the home..."; the (ex)-husband has refused to agree to split as per court orders since settlement, denying wifes claim for the ($34,064.32) owed her from joint SMSF; has also been claiming (demanding) rent from (our) daughter & myself for living in the property - whilst preparing for sale/selling : all totally & completely unjustified stalling tactics but since I can no longer afford legal representation have consistently provided invoices, receipts, bank statements, solicitor/accountants, (from both sides') correspondence - all documents evidencing my claims to my court allowed legal share of the sale proceeds; after 8 months of nonsense replies ex-husband finally ceased arguments/agreed to the $34k I am owed from his share of the 50/50 split; he is now arguing solely against my calculations - originally calculated by my previous solicitor : PROCEEDS FROM SALE OF PROPERTY - to be split 50/50% : $531,100.27 - these funds sitting in Conveyancers trust account since 9 September last 2016; DIVISION OF PROCEEDS FROM SALE OF PROPERTY (as per court orders) : Each party to receive equal share : $ 265,550.135 … read more
