Firstly no the court will not look at your actions and see them as bad!!
If anything it is exactly what you should do in such circumstances and it shows that you care for the child. The proposal that you have put forth is workable and it doesn't change that much from the status quo are you are already the principal carer for the child. That and it give meaningful contact with both parents.
We have done many of such matters in practice and i would be confident that you will have the child with you. He on the other hand will have an uphill battle trying to convince a court that what he has done is in the best interests of the child.
