Verified<p>Before the Father can take any action in court he has to attempt family dispute resolution. So if you are contacted by a family dispute resolution provider you should participate in those discussions. if you don't respond or participate than the family dispute resolution provider will give a certificate to the Father which will then let him file an application in court for parenting orders.</p><p> </p><p>Provided he attempts family dispute resolution with you he will be able to bring an application in the Federal Magistrates Court for parenting orders (as his circumstances have changed since the orders were made for the child to live with you - ie. he is out of jail). HOwever that does not mean that the court would order that teh child live with him. The court will have to consider what is in the best interests of the child. </p><p> </p><p>The fact that you have been teh child's primary carer virtually from birth will be a signficiant factor that the court will take into account. The Father will also have the hurdle of establishing that he has mended his ways and won't place the child at risk of harm.</p>
