Customer: My employer has initiated liquidation of parent company. He has 'sold' the 2 businesses under which to a newly created company. He owes significant superannuation to 23 employees. There wont be enough liquidation money to pay these amounts. I have to wait for the Australian Tax Office to prove the superannuation debt it seems, although I cant get a direct response from them about it. Im also owed wages for salary sacrifice, which I gather have transferred to the new company, given Ive signed a letter of transfer to such. What actions can I take to recover the salary sacrifice? The contracted work is in WA. The employer is based in QLD.

Customer: Ive collated figures for superannuation and salary sacrifice. The info has been sourced using electronic payslips and my super fund records.

Hes promised all employees that he will honour any shortfalls, once the liquidation process is finalised (6-12 months). I am a home inspector who canceled an inspection prior to it taking place today because the associated realtor started accusing me at 9am this morning (inspection was scheduled at 2pm) of having too high prices which were quoted accurately yesterday to her and she has stated in writing that she passed that email quote on to her client, I offered to cancel any and all services well in advance of the inspection time and she insisted I perform the inspection.She continued to spend the morning accusing me of misrepresenting our sewer scope services to her client because my booking person sent an email explaining the electronic signature required on the inspection agreement which included the 2 services the realtor texted us her clients wanted (inspection and radon test) but per the text from the agent with the 2 requested services had also stated " they may also choose the sewer scope" so my booking person explained in the email that the agent had indicated that the client may want the sewer scope and explained how they could select that service when they signed. The client then in fact did choose to add the sewer scope of their own free will when they signed the agreement last night.
I felt I must cancel the inspection because she had already threatened to tell everyone she knew that I was unethical and had misrepresented my services by using her name in the email to the client. There was nothing to by completing the inspection and in fact I would have clearly subjected by myself to more accusations had I done the inspection. Since I cancelled the inspection she has posted on a Coldwell Banker site claiming "horrifying experience" characterized with several adjectives and specific false actions she claims I took. This was seen by and responded to by dozens of agents some of whom I know and work with. Others agents called other franchise owners from my company that they work with to alert them of this libel post and the attention it was getting. She also posted to my companies review system a very long review using words like unethical and ruining the reputation of my company. I would like to know the best way to go about asking her to stop. I have in no way posted anything about her unreasonable and irrational claims. How should I proceed, sorry so wordy it has been a long and upsetting day.

I'm getting conflicting advice on filing vs serving CIV-110 and CIV-120. One lawyer told me to fill out, serve, THEN file the forms with the court, but other (on-line advice), says to FIRST file them with the court, THEN serve them.
