My car was photographed from the rear using a fixed speed

Customer Question

Hello my car was photographed from the rear using a fixed speed camera allegedly doing 40mph in a 30mph zone. I am the owner and both my wife and I were driving the same car on separate runs to the destinations in the area at or around the same time and no recollection of which one of us was actually driving the car at the time the pseed camera photo was taken. The photo does not identify the driver. Any advice pleae?
JA: What state was the citation in? And have you consulted a local attorney?
Customer: Surrey UK. No I have not consulted with a legal person
JA: Do you need to appear in court?
Customer: The notice of intended prosecution form is asking for me to identify the driver. So at this stage seems to be seeking confirmation of the driver only
JA: Anything else you want the lawyer to know before I connect you?
Customer: no thank you
