Hi, I own a small company with several vans, one of my vans was flashed going over a changing traffic light, the vans have two crew either one can drive the vehicle, we as a company keep a log of who takes what vehicle but do not know who is driving at what time. In this instance the two man team have no recollection who was driving at the time of the offence. Subsequently my company has received a Summons do I plead guilty or not guilty? please help. Yes we have, but the team are adament they do not recall.
No, of course they will say that.But you must keep corporate records.If under cross examination in court you were asked if the driver of this vehicle had killed a child pedestrian would you be able to identify him then? What would your reply be to that?Or if they had caused damage to the van?
We as a company keep records of which team takes what van, as i`ve already stated we have no way of knowing who is driving at what time. My question is can the courts procecute the company when it was an individual who was responsible?
