Hi
My apologies for the delay
Whilst these are not the easiest of application to do in person - but it is possible
It is a Part 8 application and there is an excellent guide here
http://www.slatergordon.co.uk/media/2347003/land-disputes-a-guide-to-procedure.pdf
There is no reason why the order should not be granted - and the fact that he has already moved out means there should be few problems
I hope that this is of assistance - please ask if you need further assistance
