Hi. My mother was claiming against my late Stepfathers will that she inadequately provided for as he'd tied up a lot of marital money in his own name. Now she's died does her claim die with her? My stepfathers probate was completed 5 years ago, but I didn't need to claim as my mother was.

My stepbrothers lawyer ('the other side') is quoting some old 1980 case that says her claim dies with her.

Neither my brother or I were left anything by my stepfather who was my legal guardian from 3 years old and the only father I knew. As it stands my brother and I inherit 300,000 pounds from my mum and my 2 stepbrothers get approx 820,000 pounds.
