HiMy wife played an online casino and won 30,000$ however

Hi'
My wife played an online casino and won 30,000$ however the casino is denying payment because there is a cluase in the terms and conditions that say u can not use a 3rd party credit card, my wife used my card to deposit the money to play to which she is authorized to do so. I don't think this is right, my opinion is this is not third party. Would I have a case in pursuing this?i am willing to pursue this if there is any chance just on principal.

Royal Casino I thought i was UK but It appares to be Malta ..Royal Casion is one of four casions under the fortune lounge complany.


 


 


I have copied the entire trems and conditions.. 1.2.1.3 is the condition they say we have volilated..


 


However they do not define what 3rd party is.. I am wonderning how many married couples are using this site and not knowing that if they when may not receive there winning due to this.I think this is frude given that it is not explaned in detail..Looking forward to you reply..

1.3. Refusal to Register, Deregistration, Exclusion & Suspension

We may refuse to register you as a Player or elect to deregister and exclude you or suspend you as a Player from the Casino at any time if we deem that your participation at the Casino is, shall be or has been previously, in any way not for personal entertainment [i.e. professional], fraudulent, illegal or that your participation is or has been abusive, collusive or irregular in any way.

1.3.3.2 Void all wagers that have taken place

1.3.3.3 Refund the value of all deposits net of withdrawals; and

1.3.3.4 Close the account.



1.3.4. If you feel that you are losing control of your play and would like help by restricting access to our casinos, you may choose to be excluded from the casinos for either 24 hours or six months. If you choose either of these options, you will not be able to log in to our casino software during the exclusion period. The casino will make every effort to ensure that you are blocked from entering the site. We will also take all reasonable steps to ensure you do not receive any promotional material during this time.



1.4. Consequences of Deregistration, Exclusion or Suspension



1.4.1. If we deregister or exclude or suspend you from the Casino we shall have the right to:



1.4.1.1. withhold payment to you of any contested funds whether such contested funds are deposits, refunds, bonuses, free monies, casino credits, payouts or the like; and/or

1.4.1.2. exclude you from all or any other Casinos and/or Poker Rooms in the group of Casinos of which the Casino is a member; and/or

1.4.1.3. solely determine what criteria you shall have to meet in order to establish a New Account at the Casino; and/or

1.4.1.4 in the case of fraudulent, illegal or similar misconduct by you or failure by you to pay any sums due to us:



1.4.1.4.1 furnish any relevant information about you to an intra-group database recording such mischief and, if necessary, hand over your account details to a collections agency for the recovery of any sums that you owe us. You hereby irrevocably authorize us to do so in our absolute discretion, and/or

1.4.1.4.2 have forfeited to us any contested funds that may be derived by you from fraudulent, illegal or similar misconduct.


 




1.5. Dormant Accounts



1.5.1. It is recorded that the provisions of this Clause 1.5 only apply if all of a Real Player's Accounts at the Casino and Poker Rooms constitute Dormant Accounts.

1.5.2. Accounts that remain inactive for at least 30 months shall be deemed to be dormant accounts. All efforts shall be made to transfer any balance in a dormant account to the respective account holder, failing which such balance shall be transferred to the Lotteries and Gaming Authority of Malta.


1.5.3 Notwithstanding meeting any play through requirement, in our sole and absolute discretion, you may lose any bonuses and winnings derived from such bonuses if such moneys remain unused by you at the Casino for a period of six months from the date on which such bonus(es) were awarded.


1.5.4 For the purpose hereof all Loyalty points awarded shall be construed to be Bonuses




1.6. Money Laundering



1.6.1. 1.6.3. We reserve the right to report you to the aforementioned federal or local authorities should we, in our absolute discretion, determine that we are obliged, by law, to do so.

1.6.4. In order to assist in the prevention of money laundering:



1.6.4.1. no cash shall be accepted to fund any Account at the Casino;

The problem with this agreement is it is under Maltese law. Therefore you would have to seek to enforce Maltese in and English COurt or go to Malta to enforce it.

The relevant point appears to be this - 1.2.1.5. are the true and lawful owner of the monies that you wager at the Casino and/or that you are duly and properly authorized to utilize such monies for the aforementioned purposes. This is just warranty however given by your wife. Have they said that she has breached this warranty?

Have you given them proof that she is on the credit card account?

Also prior to using the card she used her bank card that is in her name, but her card failed to work after three uses therefore,I gave her my card because her card for the same account had not arrived in the mail at that time.


 


I that they can do this,we can prove that she is the lawfull owner of the money, that should be all that matters.

I don't think any judge would side with the casino,can you point me in the right directuion to hire the correct lawyer, or recommmend someone? also am able to hire a lawyer from matla and have them work my case from here. am pissed and feel so voliated , I am also worried that many other folks can be scamed if this is not acted on.

What I want to know is based on the clause and this case what do you or your co-workers think? really can companies be so vague in the terms and conditions and legally do this. this is not right, should they not stop payment if the account name and card does not match, allowing folks to spend there money with such a loop hole is crazy. I don't care about the money, it is the principal.. complains need to be help accountable! this is unfair and unjust!! I am trying to get a lawyer in Malta, I assume I can't use a Canadian lawyer? I like a reference to a lawyer I can trust...

My opinion is you can sue this company in England if you want to recover the money, you just need to locate its address in England.

You could also sue it in Canada if you wanted as there is no exclusive jurisdiction in the terms and conditions.

I would suggest you first write to the company and give it the evidence that your wife is on the credit card account. Say that if they do not pay up within 7 days you will take further action and complain to the Maltese Gaming Commission.

Malta is a sophisticated and regulated jurisdiction, I think they will seek to avoid any controversy or anything overtly dishonest.
