i finnished work in 2005 at 50 years old because i had apacemaker fitted in 2004 because id heart problems and then ayear later my problems started again my works doctor put me forward to finish on ill health but the area doctor said i did not meet the criteria so had to take early retirement because i did not have any money i took a deferred pension and lost about 40% of my pension then last year i was sent to a doctor with my heat problems and i had a scan and was told i have heart failure which can be caused by atriel fibrilation or svt which i had when i finished work but because no doctor suggested a heart scan it was not picked up so i think i had started with heart failure in 2005 because now it is at an advanced stage would i be able to claim any more of my pension now
Hello,I am afraid you would be looking at a claim against the doctor for negligently assessing your condition and causing you to lose out on your pension rights (as you say 40%).You may also seek clarification from the pension provider but normally you would not be allowed toclaim from them as they did not advise you incorrectly.Hope this helps.
