I have had an N244 application notice served on me with a notice

Resolved Question:

I have had an N244 application notice served on me with a notice of hearing.

I don't agree with the Order the court is being asked to make or with what is said in the witness statement but there are no instructions with it how to respond.

Do I need to submit a form with my response and any supporting documents (if so which one please) in advance of the hearing or do I need to do nothing other than turn up on the day.

Thanks for your question. Please remember to click ACCEPT once you get my answer.

What is the application for?

I have just re-read your question.

You need to file and serve (send to the Court and the other side) a witness statement setting out your objections.

You need to serve this 3 days before the hearing of the application.

You didn't specify which form to use for this.

Should I write it on a particular official form (if so which number please) or do I just put the claim no on the witness statement and sent it like that?

PS Is the deadline always 3 days - I might have read somewhere it was 14 days (but I forget where and the circumstances might have been different!)

You don't need a form.

You need to supply a witness statement with any exhibited documents opposing the application.

There is no form for a witness statement. It needs to have:

1. The County Court it is in
2. Claim number
3. Parties names
4. Who the statement is from
5. A statement saying the statement is truthful.

No, you do not need to serve 14 days beforehand (thats for small claims trials), its 3 days for an application.
