Resolved Question:

Hi we bought a house 6 months ago. We paid all our fees but a few weeks later we recieved a cheque back saying we had overpaid by roughly 400 pound and that this was our money.
A month ago we recieved a letter saying they wrongly sent us the cheque and that they needed the money back.
We are a young couple buying our first house with our baby and we dont have that money and we are quite upset as we trusted them to make sure they got it right.
They are now saying they will go to the debt collecters if we do not pay it.
Do we have to pay it?

Dear Katiejane

I am sorry but I think you do have to pay it. However, I would offer something like £10 per month on the basis that you cannot afford it. Otherwise they will have to take you to Court and it is not worth it for £400.
