No he does not pay rent. he left home and moved back in without my permission and refuses to leave

In that case, you certainly can.

He is not a tenant and does not have tenant's rights.

You can ask him to leave at any time lawfully. If you wanted to do this you could wait until he goes out and then change the locks to stop him returning. There may be other reasons that you don't want to do that of course but in law you would be allowed to.

Unfortunately in this world if you want rights you have to pay for at least some of them.

To have tenants rights you need to pay rent.
