Can voice recorded evidence be used against an individual if they were unaware of the recording being made at the time in an informal meeting ? What, if any, legal come back would that individual have against the individual carrying out the secret recording ?
Hi If the voice recording was made without the consent of the individual, it is not likely to be accepted by the court as evidence, unless the person recording the conversation was also actually involved in the conversation with the individual. The individual cannot take any legal action against the person recording the conversation. The case would have been different if the recording would have been done by a company/firm, public body, police, etc. rather than by a private individual. Hope this helps. Regards.
