If your visa has expired then you are an illegal immigrant and as such you have no right to apply for ILR . there are various discretions that UKBA can be exercise depending on the circumstances but if you are an overstayer you would normally be required ot leave and reapply.

Why has your visa expired ? when did you come to the uk ? What is your spouse status ? please provide as much background as possible and I will try and give further guidance
