Can someone who has come to UK on spouse visa and the marriage

Resolved Question:

Can someone who has come to UK on spouse visa and the marriage ends within 4 months on them arriving to the UK claim legal aid to help gain rights to see their child even though the visa states they don't have access to legal funds?

Hi, The short ansdwer to your question is no they cannot as their Visa would not permit them to do so, unless there was exceptional circumstances. Has the marriage broken down due to domestic violence?

Ok, if this is the case, the non UK spouse can apply for indefinite leave to remain on the basis of being a victim of domestic violence.
