My daughter is married to an American and lives in New York.

Resolved Question:

My daughter is married to an American and lives in New York. She is British. She is expecting her first child in January. Would it make a difference, if she were subsequently to be divorced from her husband, whether the child is born in the UK or US in terms of her being able to bring the child back to UK to live?

Then it is irrelevant where the child is born in the event of a dispute your daughter will need either the father's permission or an order from the US courts in order to remove the child from the States.

Would it be the case that the US courts would be unlikely to allow her to remove the child if the child were born in US? Would the UK be more likely to help her if the child were born in UK?
