The Supreme court ruled about a week ago that the restriction on granting visas to people under 21 was a breach of the human rights of the couples who brought the case. The government has not yet however changed the rules nor made any announcement that I am aware of about what they propose to do. This means that you can apply but if you are refused you would have to go to court to get the refusal overturned. I would wait a couple of weeks to see if UKBA or the home office make a policy announcement
