You may apply for a settlement spouse visa on the basis of your marriage to a British national. Yes, you should be granted ILE if you have passed the Life in the UK test, otherwise you will receive an endorsement KOL requirement, settlement which means you can apply for ILR in the UK as soon as you pass the Life in the UK test without having to wait for 2 years as is required on a spouse visa.

You can apply using form EEA2 under Zambrano ruling if you are the sole carer of the British child and sending you back home would mean the child having to leave the UK as well.
