Can you please help to answer the following question:

I was pursing my claim for a british passport which was confiscated over 10 years ago. I was waiting to attend AIT with witness and evidence instead Home Office have offered me a discretionary leave for 3 years due to complexity of the case as they state. My question is if i take the discretionary leave can i still pursue my original claim for a british passport or do i lose my right to the british passport if i take the discretionary leave??
