My girlfriend and I have a joint mortgage but are in the processes of splitting up. I want to sell the house but she doesn't, I have been paying the mortgage for the past two months even though I have moved out. She cant afford the mortgage, what is my legal situation.

In that case under property law you can apply to the Court for an Order for the sale of the property at any time.
It is called a Trusts of Land and Appointment of Trustees Act application (TOLATA)
The Court WILL order the sale - and may well award costs against your ex - so a firm letter from s Solicitor may concentrate her mind
