Customer Question

Hi, I asked this question previously, and clearly I chose the wrong attorney. The attorney I used charged $500, he twice got continuances, (which I didn't care about), but then I received a letter giving me only one days notice, (technically less than a day, I received it in the afternoon and had to be there the next morning). When I arrived, I met my lawyer, and he knew absolutely nothing about my case. I wound up getting the same punishment the $250 lawyer said I'd get. I wouldn't care about the outcome or the fee if I felt like they had actually done any work on my behalf, but as I said, they wern't familiar with my case when I arrived, and basically got me the same settlement I was told I could get elsewhere, cheaper or by myself. Do I have any recourse, even if it's just finding a way to be a nuisance and make it easier for them to give me a partial refund? They did nothing for me. Thanks.

Dear Jon,

Have you contact this lawyer to express your dissatisfaction and if you did what was their response?
Customer: replied 2 years ago.

I would categorize his attitude as "you win some you lose some", which I especially didn't appreciate because the part I forgot to add in my original question, is that I received a 20 day license suspension, effective immediately, so I had to drive home from court with a suspended license which could have really made it a disaster.

Dear Jon,

Thank you for your follow up.

Aside from appearing not being prepared for your court hearing, was there any other issues with this lawyer as far as the lawyer being competent?

What state is this in?
Customer: replied 2 years ago.

HI Alex,

Sorry, I am in and out today. I don't know if this counts as incompetent, but he was clearly misleading. He said they worked that court all the time and knew the judge very well, and badly over-promised what he could do for me. If I recall now, his exact word's were something to the effect of "it's too fast, there's nothing I can do about it". Of course it goes without saying that his big promises were all on the phone and I don't have a witness to them. So in addition to the points and suspension, I had to pay $230 plus and extra fee to lift the suspension.

Beyond the incompetence and laziness, is that when I called another law firm, who were $250 instead of $500, they also said they knew the judge really well. They also said he was really strict, and they told me exactly what I could reasonably expect them to get me as part of a plea. And the sentence I received is exactly what they promised.

I mean I know I gambled, figuring why not pay the extra $250 and go for the guys who say they can get me off much lighter? But clearly they were selling me a pack of lies, and couldn't even be bothered to make it look like they were trying, let alone shocked that that they couldn't deliver on their promise, although in fairness, as I said the guy who showed up knew absolutely nothing about my case, so I doubt he knew what I was promised either.

Thank you for your follow up.

Did you have a written reatiner agreement with this lawyer?

Did the written retainer agreement contain language such as "the lawyer does not guarantee the outcome of the case"?
