I'm sorry to hear of the confusion.

In 2006 CA changed the law and there is now no differentiation between 49CC and above.

Minimum age to operate a scooter is 16 and you must have a drivers license.

While a 1000 watt or less electric moped may be driven without a license, the operator must still be at least 16 years old and wear a helmet---either bicycle or motorcycle style.

All other motorized bikes, scooters and mopeds require a license and the driver must be at least 16.
