Statutory Rape Laws

Statutory rape refers to sexual relations with a minor. Many states consider sex with a minor to be a crime and an individual who indulges in such relationship may be charged with statutory rape. Considering the different types of rape that the law defines, it may get difficult for people to understand statutory rape at times. Given below are important questions that have been answered by Experts about statutory rape.

Would an individual be charged with statutory rape if he had sex with a minor and got her pregnant in Pennsylvania?

The age of consent is 16 years in the state of Pennsylvania. Hence, unless an individual has sex with a 15 year old girl and gets her pregnant, he/she may not be charged with statutory rape as the sex would be considered consensual.

Would an 18 year old individual be charged with statutory rape if he/she had sex with a 16 year old girl in Oregon?

Having sex with a 16 year old girl may be considered a crime and the 18 year old individual may be charged of statutory rape. However, since the age difference between the two is less than 3 years, he/she may use this as a defense while requesting for a plea bargain.

What is the statute of limitations for aggravated statutory rape in Tennessee?

The statute of limitations for aggravated rape in the state of Tennessee is 4 years from the date the crime was committed.

What can an individual do that is on probation for statutory rape if he/she wants to move to a different state?

If an individual wants to move to a different state, they may request the court to modify the terms and conditions of their probation in order to permit them to move to a different state. The individual may also file a motion at the court where the case was registered originally. If this request is accepted, the probation may be moved to the other state. In some cases, if the individual has finished half the term of their probation, they may also request for the probation to be terminated early. However, if the individual has not violated any other laws, the probation may be terminated and they may be granted to go wherever they want.

Where can an individual apply for a clemency pardon if he/she was convicted of statutory rape in Missouri?

If an individual was convicted to statutory rape in Missouri, then he/she may have to apply for the clemency pardon in Missouri itself. He/she may file the application on the following link: http://doc.mo.gov/documents/prob/CLEMENCY_APPLICATION.pdf.

Can a statutory rape charge be expunged from an individual’s record in Virginia?

An individual charged with statutory rape may qualify for expungement under the following circumstances in Virginia:
He/she pleaded not guilty at the trial
He/she was issued a complete pardon from the Governor of Virginia
He/she was a minor when the crime took place.

What action must an individual take if they are being investigated for statutory rape in Michigan?

If an individual is being investigated for statutory rape and has not been charged, the individual may hire a criminal defense attorney to help them. They may not speak to anybody in the absence of their attorney.

Where can an individual report statutory rape?

An individual may report an incident of statutory rape with the police or the local district attorney’s office. If the individual also wants to sue the accused in a civil claim, he/she may hire a personal injury lawyer to do so.

The age of consent may differ in different parts of USA. Hence one must be sure of the law when getting into a sexual relationship with a minor. He/she can get charged with statutory rape if he/she has sex with a person below the age of consent. The penalties for statutory rape can be different in various states giving rise to a lot of confusion and questions. You may speak to an Expert and clarify any doubt that you may have about this crime.

  • First & foremost, this is not regarding myself. I am looking

First & foremost, this is not regarding myself. I am looking for answers for a family member of mine to give them the best advice and most accurate answer. I am looking to see if a 20 year old boy can get in any legal trouble for having sexual relations with someone who is 16, now 17. The issue is that she is pregnant, and if the math is accurate, she conceived right before her 17 birthday. It was consensual sex. However, I worry years from now if the family gets mad at him, they can use this baby as evidence and charge him for statutory rape.
  • My next door neighbor claims a wind storm caused damage to

My next door neighbor claims a wind storm caused damage to his car. I had a tent trailer with a loose fiberglass roof that had two concrete blocks on top to hold it down. He says a wind storm blew the fiberglass roof up causing the block to fly over a pickup and dent the back of his car. When I can home, the roof was indeed blown up but one of the two blocks were still sitting on the tent trailer. The other block was now in his possession where it remains.

This neighbor has been an avid user and dealer of controlled substances and has a lengthy history of filing false police reports. I suspect his car was dented another way and he’s attempting to get money from me. I don’t know how one block could fly through the air while the other remains unmoved.

I asked him to send me any proof & estimates via USPS registered mail, but he refuses. Instead, he yells to me whenever I’m outside and texts my phone. Via text, I told him never to contact me directly again, to only use USPS registered mail yet he continues to text. Getting my number changed today.

I, and most other residences on my street have a lengthy history with this one neighbor. He’s filed false police reports against me and several other neighbors covering such things as giving alcohol to minors, allowing illegal immigrants to live in a garage, statutory rape of a minor, and attempted battery. All were investigated and discharged. I, with the support of most of my friendly neighbor’s, successfully obtained a one year injunction against harassment that has since expired.

If a wind storm blew something from my property onto his, am I legally responsible to cover the damages? Is he legally required to supply proof of how the damage occurred? He does not live an honest lifestyle and routinely has unsavory visitors that he himself won’t allow in his house, which angers them greatly.

This will likely end up in court and I’d like to work with someone repeatedly throughout the process.
  • I am writing a book and need a list of titles of criminal charges

I am writing a book and need a list of titles of criminal charges that could be made against a thirty-five year old married man who takes a non-family member female sixteen year old summer youth intern across state lines on a "business trip", shares a room with her, and has repeated sex with her. This is done without the consent or knowledge to the employer, or the parents of the summer youth intern, who were told that the summer youth person was on a training trip unrelated the man's business trip. The summer intern felt compelled to go due the postiion of the man in the organization and was threatened with loss of position if she did not comply. I do not need statute numbers (i.e. penal code 8.12.23), instead I need the generic titles of the charges brought if the District Attorney were to throw the book at him. I do not need all the lesser included offenses. Your answer might say, statuatory rape, kidnapping etc. Do not worry about difference between State law. I am looking for a genXXXXX XXXXXst only
