We live on a "private road" that we may just have "use" of to get to our home on a dead end road. There is only 1 other home / "owner of the road" who resents the building of our home on a legitimate town lot. She has narrowed the road so that barely ONE car can pass and has gotten upset the ONE time (in 5 years) when we have had a friend park in the road - allowing another car to pass - -as she has claimed that they ruined her grass. The last I heard when I contacted a lawyer through this service was that they wouldn't be completely in the fact until at least June.Have these new rules in fact gone into effect get? If not then when? I am an Agawam Massachusetts resident and needed to know about my legal recourse concerning my car being towed from a private business. I want to let you know writing this is therapeutic for me so I apologize in advance for the length. There was a sign saying customer parking only but it was about 50 feet from where I parked my car. Furthermore, the sign did not say the car would be towed at the owners expense. It was also obscured by other vehicles blocking it and the lettering was too small to see from where I was.I obviously would not have parked at a business that said no parking vehicles towed at owners expense. Interestingly though, I was going to the police station next door with my 8 year old daughter to look at bikes because they were having an auction. We did not see anything we wanted and were only next door for literally 10 minutes. I know this because we got to the auction at exactly 10AM when it started. Then I looked at my phone again when we got next door to ask the barber shop where my car had gone. The barber said the owner had the car towed. Long story short, when I called the tow company he told me it was a $140.00 charge for the tow. I questioned the barber about how the tow company could have gotten to his shop so fast, hooked up my car and gone in under 10 minutes. He just reiterated how it was private property and he had a sign posted. The parking lot where this shop is was packed so I assumed lots of people where parking there for the well advertised auction. Again there was a car parked in front of the one sign the business had on the side of the building. The guy could have said hey buddy don't park your car there its for customers only and I would have left. His door was wide open so he obviously saw me right away.So here are my questions: Do I take this guy to small claims court for my $128.00 plus court costs? Can I win? I have a picture of the sign from where I was parked and you cant read it. What are the laws in Massachusetts governing this? Would there be town laws too?This is where it gets interesting. I received a ride to the tow company within 20-30 minutes and talked to the guy that towed my car. As we were doing the paperwork the barber guy called the tow truck guy and asked if I had picked up my car yet. I know this because I asked the tow truck guy after the call and he said yeah he's my customer. I thought that was odd. Why would the barber call to see if I had picked up my car? Before he hung up he said "yeah he's here" and "he couldn't talk right now" and that's when it hit me. I had been set up. The business is next to a four family house, the police station with limited parking is next door, and a few other businesses are around the shop. He must get a few tows a month and get a kick back from the towing company or just this particular driver. The barber calls his buddy up (the tow truck driver) he flies over and in under ten minutes they earn $128.00, that's how much the tow actually cost. I don't have any proof that the tow truck guy is giving the barber any money but why would he want to know if I had picked up my car? And, why would he call the tow truck drivers cell phone 30 minutes after the car had been towed. Why would he care if I got my car or not? There are a few things I do know though. I know the customers only sign is too small at the barber shop next to the police station. I know I will never get my hair cut at this establishment. And, lastly, I know my eight year old has to wait another year for a bike because money is tight and we can't afford to get her a new bike. What is this world coming to! I was involved in an Auto Accident 07/12/14 where the other driver's insurance has accepted 100% of the liability and the driver was cited for Careless driving and failure to make a proper lane change. My car was totaled and I had to go to the emergencyroom for the pain I was experiencing from the impact and the airbags and seatbelts. My Chest Was Badly Bruised. The Emergency Room discharged me with Painkillers, after running a battery of tests and X Rays.. I was told Bad Chest Contusion (Bruise). I couldn'tget to a follow up doctor for about a week as I could barely move without pain and developed a Hematoma the size of an Egg on my Chest from the Airbags. I retained a Personal Injury attorney who took pictures of my bruises and injury and I was lucky that afriend came to the Accident site so I had High Definition Pictures to give to my Attorney of the Property Damage at the scene of the Accident where I was side swiped and sent my car head on for A Palm Tree at 30MPH which thank goodness for the airbags I wouldhave never survived. My personal physician or anyone I knew did not accept or get involved with Personal Injury Cases so I got a referral from a friend to see a Clinic that did and I was examined and X Rayed there to comfirm Chest Contusion with Hematoma andalso given NSAID Prescriptions and Pain Killers and was told I needed therapy after I was complaining of Neck Pains, Headaches Shoulder Pain. I proceeded to attend therapy sessions 3 times per week for over 4 months as I still was not getting the relief. Idid for salary purposes go back to work after one week but if it weren't for the NSAID pills I never could have done that and even with that I was in awful pain as it would take some time to heal. I was given a Prescription for an MRI of the Cervical Area.I was diagnosed with 2 Herniated discs in my Neck and one Bulging disc in my neck as well. I was then referred to a Neurologist or Spine Doctor. He examined me and reviewed the findings of The MRI... He said it this point I do not have any numbness or tinglingand the Risk of any kind of Procedures such as Injections or Surgery would outweigh the POSSIBLE Benefits and he would just continue to deal with Therapy but it was my choice to take his advice. He closed out his portion of the case. On the psychological sideI have been seeing a Psychologist and Psychiatrist for over 27 years for Anxiety Disorder from personal issues however after the accident I had to consult with them again as I as completely panicked to get in a car again, having nightmares and waking up withcold sweats. I now was diagnosed with Post Traumatic Stress Disorder and My Psychiatrist has had to up the dose of the Anti Anxiety meds because this had elevated my Anxiety Disorder to a whole new level. It made a safe driver of 35 years into A nervous driver.In fact I got into two fender benders in December 2014 which were my fault this time but it is because I shake every time I get behind the wheel and it has made me a jittery driver but I need to Work For A living and Commute. The Driver at fault in the JulyAccident has $100,000/300,000 Liability Coverage and again they have accepted full liability. Now to my Concerns ..: I am not in this obviously to scam a system but I have seen friends of mine be in a little fender bender and walk away with $15,000. My lifewill never be the same since this accident . I used to love to drive and Now I fear that every driver on the road could possibly send me into a Tree. The attorney finally submitted his Demand Letter to the Insurance Company at fault asking for a settlement(Which I am sure is normal) of the maximum amount of coverage $100,000. I got a letter yesterday from my attorney which seemed like a form letter and I can't talk to him until monday as this a Weekend. The letter stated that they submitted the demand letteron my behalf to Liberty Mutual on 01/09/2015.. They just received a response which was attached saying that based on the fact that Mr Baker has no out of pocket expenses they would settle for $1600. My Attorney wrote in the standard form letter that this isonly the first step in the negotiations process and to call him to discuss how we are going to proceed and they will keep me informed of any other negotiations This letter made me so upset ..What is next?? I was involved in a very minor MVA in our drive way in the apt complex we live in. A new tenant was moving in and parked in the driveway and did not inform me of this. There was an open space (available at that time) next to the drive way where people would park and move into the apt so as not to block the drive way. I was backing out of my parking spot, backed around the corner of the building (couldn't see the parked car) and assumed there were no one there. I always look at my side view mirror to ensure that I am backing up straight as to not hit the building the drive way is next to. Neither my wife or my daughter saw this vehicle since no one parks there. Am I responsible for the damage that occurred to his vehicle?
