Rent Control Laws

Rent control occurs when city or township officials take control over how much a landlord is allowed to raise rent. Major cities across the country have rent control laws set in place. Usually, a city government will install a rent control policy if the need for such an act is needed. There are many people for the rent control laws, while there are as many people against it. Many landlords think they are being kept from earning a profit when the city government has leverage over how much a landlord can charge for rent. However, on the other side of this coin, renters are relieved that the rent controls are installed to regulate the amount of rent increases the landlord can issue. To learn more about rent control laws, take a look at the questions below that have been answered by Experts.

Is their rent control in Wallington N.J. If not how much can the rent be increased at a time?

Rent control is controlled by city or township ordinances. Online searches haven't found the ordinances for Wallington N.J. You can contact your City hall to verify if there are rent control laws for your city. Over 100 cities around Wallington have rent control laws, so it is possible the city has them. While there are rent control laws in effect for most cities, a landlord has the right to increase rental amounts once a year. These rent increases are known as annual increases. If the landlord can show that he/she isn't making a fair return on rentals, he/she may approach the rent control board and request above the set amount due which is called a hardship increase.

There are no specific amounts listed in the New Jersey statutes that specify how much a landlord can increase a tenant's rent, however there are specific steps a landlord must take when wanting to increase the rental amount. The landlord cannot raise your rent during your lease period. The landlord must wait until your lease is close to ending and notify you that there will be an increase in the rent upon lease renewal.

I live in a rent control area in Los Angeles California. I purchased a property where the renters are only paying a third of what the going rates are in the area. Can I change their month-to-month tenancy to lease and would it benefit me to do so?

By raising the rental rates, you as a landlord would benefit. Because of the month to month tenancy, you would be able to raise the rental amount once you give the renters a 30 day notice of the increase. However, there are stipulations that must be followed for rental units in a rent controlled area. To protect yourself from breaking any ordinances, you should check with your local laws to ensure that the rent increase will not be in violation of any rent control laws. If your rental property contains 2 units on the same property and the rentals were built before 1979, the units are protected by rent control. To find the exemptions from rent control, you can look at the Los Angeles Municipal Code at Section 151.02. Los Angeles Rent Stabilization Ordinance.

In a house without rent control in San Francisco, my landlord has raised rent from $2200 to $3000. Does my landlord need to send a new notice or does the rent increase begin 60 days after the notice?

If the landlord hands the notice to you, you will have 60 days before the rent increase will take effect. If the notice is mailed to you, you will have 65 days. In the notice, there must be a date listed of the rental increase. If there is confusion on your part about when the rent increase will begin, you can contact the landlord and confirm the increase date.

I live in San Bruno Ca. If I'm paying $1150.00 in rent, can the land lord raise the rent by a 100.00 to 1250.00?

San Bruno isn't protected by the rent control; therefore the landlord can increase your rent as long as he gives you notice of the increase. Generally, a landlord is required to notify a tenant of rent increase with no less than a 30 day notice. If you have a lease, the landlord must follow the terms of the lease when increasing the rent. If your landlord doesn't give a 30 day notice of the rent increase, you can file a complaint with the State Attorney General Consumer affairs unit.

Is there is some legal process in which an apartment building that is not under rent control could be placed under rent control?

There are situations when renters fell overwhelmed by constant rental increases, especially when they live in an area not protected by rent control. You can contact your local tenant's rights organization. The org. will offer any information pertaining to rent control for your area and send you in the right direction.

Rent control laws protect renters form ever growing rent increases. If you are unsure if your area provides rent control, you should ask an Expert. It is important to know if you are protected by rent control, especially if you are dealing with a landlord who continues to raise your rent.

  • Hi, I am seeking advice with the below matter. At the end

    Hi,
I am seeking advice with the below matter.
At the end of November this year I have purchased a puppy via online platform and I am expecting for him to be shipped this week. I have paid for him the full price and was just expecting for him to be delivered. However, the health report was disclosed to me today that the puppy has has a preflight condition otherwise known as an undescended testicle; which may or may not be a congenital or hereditary disorder. They have asked me to sign puppy disclosure waiver in which I will agree to accept this preflight condition and hereby grant the breeder full and final release of all claims that I have or could have had in full settlement and satisfaction for the disclosed preflight issues and as sole consideration for the final release and discharge of all actions, claims and demands whatsoever, that now exist, or may hereafter accrue.
Is this something I should be forced to sign? I have also signed the purchase contract in which I agreed that if I decide to cancel anytime before the shipping, I will have to pay an admin fee.
Can you please advise me what are my rights in this situation?
