Informal Probation Rules

What is informal probation? Informal probation is a type of sentence that can be given to an individual on their first time offence when the individual has admitted to a less server crime. Within an informal probation, the sentence can be lessened in order to help the individual restore and stay away from committing future crimes. If an individual is on informal probation and violates their terms of the probation, the individual’s sentence can be canceled. If a sentence has been canceled this can result in formal probation and even jail, this will all depend on the severity of the violation and the original crime.

What are the next steps and results for receiving a ticket for driving on a suspended license and no headlights while on informal probation?

You may pay for the ticket you received for driving without headlights. Your license may be suspended for longer and you may get a fine or jail time for driving on a suspended license. It is likely that your probation may be revoked or extended. Also, Driving Under Suspension (DUS) is a Class A Misdemeanor where, as per IC 35- 50-2 “A person who commits a Class A misdemeanor shall be imprisoned for a fixed term of not more than one (1) year; in addition, he may be fined not more than five thousand dollars ($5,000)” .

I have been on informal probation for driving under influence (DUI). However, I will have to prove why my informal probation should not be revoked at the next hearing because I failed to attend a class ordered by the court because of work. What recourse do I have?

The main requirement of an informal probation is that you should not break the law again. Also, the court has the discretion to revoke the informal probation if you violated the terms set by the court irrespective of the reasons you provide. Failing to comply with the court’s conditions may lead the court to further penalize you for the maximum penalty allowed by the law (including jail up to 6 months, a 6 month suspension of driver’s license and a fine of up to $1600).

How can an individual get a dismissal from informal probation so they can get into the military service?

Only the Judge who placed you on probation is the only person who can dismiss your probation. You must ensure that the motion for early termination is heard in front of the judge. However it may be unaware of who the request had been viewed by or why the request was denied, but it may be possible that the individual may reconsider their decision if they are aware that the individual is trying to enter the Military.

I have been placed on informal probation for five years for driving under influence. Will I be able to join the coast guard while on probation?

A lot will depend on how your informal probation is monitored. If you are not required to report to an officer periodically, you will be able to travel while on Coast Guard duty. Also, it will help to talk to authorities at the Coast Guard. The Coast Guard may have certain rules about the sort of criminal convictions that are permissible for recruitments.

Typically, an offender who violates the terms of informal probation or gets a warrant for arrest during such time, will face the penalty that was suspended when given the probation.
